Did your friend have insurance on the car in his name? If he did LIE, tell the court that you believed that his insurance covered you as well (if he had fully comp insurance - check it out as it is possible it will cover ANY driver for third party insurance automatically), grovel, plead and beg. The points are not automatic and the judge can instead impose a fine in lou of the points - this may cost you a few hundred quid, but then you have to decide how much your license is worth to you. Speak to your solicitor about this, explain that you need the car for work (to get too and from your job ect) and that if you lose you licence it will have a direct impact on your living. Remember to be contrite and sorry of the offence, beg and grovel a little bit, you might get away with it.

OK, first things first. Is you mate insured?

Does his insurance policy entitle him to allow other drivers to use the vehicle, if not, sadly you're screwed.

You could just get a caution, but more probably 3-6 points and a £100 fine. If you are going to get 6 points - you will effectively get a ban, and have to do a re-sit. When you get a ban a court appearance is advised (practically mandatory) - this will give you that chance to POSSIBLY get say 5 points and keep your licence if losing it would mean 'extraordinary hardship', like losing your job. Best of luck anyway.

I will say it again.. IF you drive a car on a public road WITHOUT valid insurance you are Guaranteed 6 penalty points. Ignorance will not help you. Driving a car is a privilege NOT a right .You are not exempt from the rules just the same as I or anyone else is not exempt from the rules. If you are a new driver then yes you will have to go back to learner status again.S hit happens

In reply to one of your respondents
Notice of intended prosecution doesn't apply to no insurance.
You don't really need to be cautioned at the scene because all the Prosecution have to do is prove is you were driving a motor vehicle when stopped by Police and you were not in possession of adequate insurance cover. Police officers do usually attend court, they have to, and will id you if required. I suggest you get a solicitor, make a full admission (magistrates don't like time wasters or those who deny what is blatantly obvious) and plead for leniency of the court due to bereavement, stress or similar.

Were you an illegal asylum seeker benefit claimant, a few times over the alcohol limit, driving without a licence, while banned and without insurance then you might be unlucky enough to get a tap on the wrists or maybe a few points. However as a (generally!) law abiding member of the public who normally operates inside the law you can expect to recieve something particularly harsh and inappropriate. That said you shouldn't have got caught in the first place so take it on the chin and let it be a lesson learnt while you're young. Good luck!
