Native Americans can do anything they want on their "sovereign" land. That means if they want to gamble, drink, perform abortions and smoke the peace pipe they are free to do so. We are essentially granting the Native American's the same right any sovereign country would have. Like the rights they had before we kicked their asses off of their land. I think it is the least we can do.

The Indians are a Nation with in a Nation, they have their own laws and police, unless they break Federal laws, it is their land and we have treaties with them. They have a right to do what they want on their land or Nation.
