I'm on jury service and I can't decide if the defendant is guilty or not. What do you think? I wish I could give you the details but I can't. So in your opinion should I let the poor unfortunate guy go or send him down for a long stretch?

Unfortunate because he got caught.

Take it you're not in Scotland where we can have a verdict of not proven, but if in doubt, the rule is innocent until proven guilty and if you're having doubts the answer is that guilt has not been proven, therefore innocent.

It's all cr*p anyway, if you were on jury service, you wouldn't be asking for an answer on here.

I know exactly how you feel. I have been summoned to jury duty several times, and I always tell them the same thing - I do not feel that I can judge someone else. To many times you read about some poor soul that was put in jail for something they never did, and years later, from dna testing, find out he is innocent after all. On the other hand, if someone is guilty and jury says he isn't, then you have a criminal running around. I would not want to be on a jury. I feel sorry for you, but that is just how it would go down with me. I would just have to tell them that I could not make a dicision. Sorry I can't be of more help. Good luck to you whichever way you have to decide. I pray that you make the right decision

The judge will direct you on what you must do based on the evidence you have. I was on jury service a few years back and some plain guilty defendants were let off, a) because half the jury were from the area the case was and kept dominating preceedings with their views being the only right ones and b) the evidence was poor.
The only reason you should find the guy guilty is if the evidence points that way beyond any reasonable doubt.

Go over the evidence that was presented to you and based solely on that and the instructions that you were given make a decision if the DA proved beyond a shadow of a doubt, that the person that is charged committed the crime.

I wonder how you were able to sit on a jury! Fancy sympathising with the defendant just because he was caught.

Of course, he is guilty as sin. But that is not what you are there for!

Is he guilty as charged? If not, you will have to let him go!
