I don't see why it's not legal. Because it's not an actual gov issued doc with the seals and things they can't do anything with them. However if you do copy it make sure private info that you don't want them to have is blacked out. The best way is to copy it, black out the section then copy that second page. That way they can't just read through the blacked out stuff.
They do that so that if something were to happen to your passport (like it getting stolen/lost) your travel agent would have a copy of it to file with the gov so that you could get a replacement.

This is not illegal and it is done for your protection. Sure you can decline, but why would you? Your agent for doing this is smart and you should feel lucky you are working with an agent who knows there job because not all agents do.
I also make a copy when I assist someone with a visa application and we send it out via ups. You always take copies to keep record of this in case anything is lost you have something at least. We keep this in client files, well I do anyways and most agents I would say do as well. Depends on there filing system.
There is nothing on a passport that is private anyways. Unless you don't want us to know your birth date there is nothing more I would consider private to even feel the need to black any out. In fact I wouldn't you start blacking stuff out and you loose your passport there goes your chances of US trying to help you back into the country.

I don't see why it would be illegal. I've asked clients to send copies for visa purposes, or to enter info into profiles. Some airlines are now asking for this information to be entered with the reservations. Plus, if for some reason you lose your passport, you know someone has a copy and can fax it to wherever you are. That would help at the embassy to try to secure a new one if it is lost or stolen. I would recommend that you keep a copy yourself separate from the passport just for this purpose.

the only way it would be illegal is if they made color copies.
yuo can and should have copies yourself of everything from your drivers lisc, passport, credit cards, insurance cards, etc with you at all times and leave a copy at home with a trusted family member.
i work in a hotel and we will often make copies of the ID used to verify that the person doing the transaction is the legal person. the TA may also do it to have on file should something happen to yours while traveling.
