The papers today say that the little airplane was off its altitude by 1000 feet and had shut off its collision-avoidance transponder and that is why the big plane hit it.

I am following the investigations on this accident very closely and apparently the smaller plane may have had some involvement with the crash, yes.
What makes me ABSOLUTELY mad is that the pilots are criticizing the air control procedures in Brazil saying that they are awful - untrue, since they had the TRANSPONDER of the plane turned off, bluntly ignored tower instructions five times to change altitude, and now keeps changing his story between 'not being in the cabin at the time of the crash' yo hear the warnings and 'having the volume of the radio down and could not hear the tower'. Along with this, he was doing an illegal maneuver ( flying at 37k feet in altitude instead of 36k, which was confirmed illegal for planes flying the west route by a big shot aviation lawyer from New York on the papers yesterday!!)
I say...the experts will tell the real story. Just wait and see!!! Now we have155 innocent people dead!
My biggest question is...why did they have the transponder off? They'd only do that if they were drug dealers or terrorists trying to deceive their route to the tower. Very strange, as anyone in the air industry can confirm.

They don't know yet. The fact that they are trying to blame US pilots and getting huffy when someone asks about air traffic controllers, tells me they are getting ready to spin the issue so Brazilians come out clean as a whistle.
