my boyfriend and his ex have 2 girls,they stay 11 weeks with us and the rest of the time they live with the ex.The ex gets the child benefit,but i was wondering if by law my boyfriend can claim for the time that we have them?

by rights, you and your partner should have the child benefit for the weeks you have the children, after all , the money is for the kids, not the mother to drink away or go clubbing while you babysit her children, as i said, the money is for the children

I think there is a minimum length of stay applies but I cant remember and it may have changed since I was looking at this sort of thing. See a solicitor - it might be worth it as not only might you be able to get the child benefit, there may be family credit and or maintenance payments for that time. You certainly dont need to be paying mum any maintenance for the 11 weeks the girls are with you. We were in a similar situation as you but we went for keeping the equilibrium instead. We wanted the child in question to feel comfortable and happy and knew that it would make a lot of trouble if we tried to mess around with the money. He is grown up now and we dont regret leaving it well alone. But thats not to say that you should be the same. Each situation is different. Good luck.

Its not easy being a single parent. Even if your partner pays child maintenance it is still a difficult life bringing up children on your own. Child benefit can really help mothers with bills, groceries, clothes for the kids etc. Are you serious you want to have some of this money for the few weeks a year your boyfriend has with his children. Im guessing you dont have any children. One day you will understand. Until then stop interferring and Id guess stop putting ideas into your boyfriends head.

According to the tax rules for a dependent, you have to provide more than 1/2 the support for that person. Since you only have the children 11 weeks (I am guessing this per year) they would not qualify as a dependent for a deduction.

i think it would be very mean of you to ask this woman for the child benefit. Your boyfriend should concentrate on being a good dad to his children and not concentrate on the money issue. Child benefit is very important to mothers. It would be a bad idea for his relationship with their mum to ask for it. good luck

This sounds like a case for the:

CSA

I wouldn't bother contesting it, it will be referred to the CSA and as an easy target you will pay through the nose.

looks like he might if they were married...but chances are his ex will not want to do that because she counts on that money probably....your boyfriend would have to check into that hisself...they may just think he owes it to the children...and he probably does like being with his kids....

most of the time they have to be with you 6 months or more.

No, she has them in the main, but i would think he would be entitled to any maintenance he pays if it is a continuous period

I don't think so I think it's only for the custoial parent who has them the most.
