In most states the father has to be present and sign paperwork to be added to the birth certificate only if the mother is NOT married. If married then her husband is assumed to be the father. Usually the mother can not list a name if the person is not there. This is recent as there have been too many cases of the wrong man being listed and paying years of child support only to find out later with DNA that he is not the father.

If you have been careless and did not keep track of who the father could be then DNA tests are usually ordered.
If you trully do not know and tell a man so that he assumes it is his then that is fraud.
In the case of rape victims who become pregnant and do not choose an abortion; and where the identity of the man is not known then the father is listed as 'Unknown'.
Bottom line: Unless you're forced, try to keep track of who you sleep with.

From my experience, anyone you list as the father will have legal rights to the child, no matter what actual paternity shows. Think carefully about this. If you just put joe bloe anyone on, then that person could try to sue for custody. Even if they didn't win, can you afford the legal battle? On the other hand, if your boyfriend is exceptionally loving and would make a good father, it's a lot easier than adoption. Don't put relatives on! You'd have a whole lot of mess with incest laws.

If he also wants his name on the certificate then yes you can. If he doesnt, and you do it without his consent and he wants a test, then you might be in for a big lawsuit. So make sure this is what you both want. Anyone can be on your childs birth certificate, its just up to them to make that decision, not you. In some states you cant unless you are married. In some states you cant without him being present and consenting to it in front of witnesses due to women lying and stating that they know who the father is when they really dont. If this man wants to be the father of your child, he should be there when the baby is born anyway, and unless they require you to be married in order to have him on there, then he should be able to sign it.

Okay I know for Wisconsin you can NOT put a man's name on the birthcertificate unless you're married, he sign's an paternity acknoledgement form or later you have a test performed. I was not married with my first daughter and my fiancee had to sign the form and they went over all the legality of it with us. My daughter was born a year ago, so I don't think much has changed, but again that was Wisconsin.

You can put the person done, but if it to count they have to be there at the time and sign the birth certificate. Then if he denies it and all it gets down to taking blood tests and stuff.

You definitely should not put the name of the father unless you are positive. Have a paternity test done if you are unsure. It's better to be safe, than sorry.

Also, talk with your doctor and explain that you are unsure of who the father is. Your doctor will advise you what to do.

You can put any name you want on the birth certificate, but make sure the other person knows.

In most states the only way for a mans name to appear on that is to be married. My sons fathers name is not on his because we weren't married. It reads.....Father Unknown

I guess you could...but why would you do that...are you going to give the child his last name to and have you too discussed this? If you are doing this just to have a daddy's name on it, b/c you don't know who the real one is...then you have issues and shouldn't be having sex with so many people so often! My dad was an *** to me, but at least I know who he is!

nope...the father of the baby has to be there to sign the birth certificate. this i know because they would not let me give my daughter her dads name without him being there and signing the birth certificate himself.
