Ok, Ive never done anything wrong (criminally), this is going from the 1st and 2nd question I asked about the car situation...1st Do you think it would be a good idea to ask for a jury trail, I added a comment on the last question about asking for a jury trail, I am thinking if I get a jury trail it would be more fair towards me instead of the judge using law bullshit. Also if I was to be convicted how bad is the punishment for auto theft (on your own car)? Even if I was to go to jail I would be bailed out ASAP, but I was told it takes up to 4 hours for all the paperwork crap and blah blah, would I actually be put in a cell and if so how bad is it? This sucks all I tried to do was help out a freind and now going thru all this ****

Ok more details...the car I sold to a friend, we had a verbal agreemnet on monthly payments..I gave them the title without putting myself as a lein holder (dumbass me) this was back on March 29th I signed it over to them, as of Aug 11th they still had not transfered the title into their name, and was not paying, I went and got a duplicate title (which voids out the title they have), the car got impounded so I went and got the car out of impiund and they are charging me with Auto Theft...Grand Theft Auto in Indiana is I believe if the car is book vauled over a certain amount...which the book value on this one is not even $2,000. The car was never put into their name, they never properly plated it, never insured it, if was also informed by a 'law official' if that car was sitting on the side of the road somewhere all they do is run the VIN # and it would have come up my name so I would have had to come get it..or if they were in an accident they could have claimed not having the title.

Call a good attorney. Set up an initial consultation (usually free), and get some solid support in this matter taking your individual State's laws into account.

If you choose a trial by jury it is more likely that you wil face jail time. Especially if you are guilty, its hard to say what the Judge would say. I would not take the trial by jury, make it as fast and painless as possible.

definitely get a jury trial. the jurors will likely be sympathetic and hopefully relate to you. goodluck
