If the President is refered to as The Commander In Cheif of the Miliyary dose he also Fall Under The Military Code Of Justice?

If he is, can he be punished under military law?

Okay, back up sparky...

The Office of the President also holds the title of Commander in Chief of the Armed Forces as defined in the United States Constitution... He and the Secretary of Defence are civilians with control of the military. Read the UCMJ to see who IT covers... No elected officials.

With regard to Slick Willie, he tried to HIDE behind the Soldiers and Sailors Act... which prevents military members from being sued in civilian courts while they are deployed or otherwise unable to attend due to duty.

Blaine - Bill Clinton wanted to delay the sexual harrassment lawsuit by Paula Jones by claiming he fell under the Soldiers and Sailors Act... he doesn't.

However, a number of us on active duty laughed, because if he wanted to TRY to hide under the UCMJ... then they could tag him for Adultry and Sodomy. I think White House counsel let him know the problem there.

Uniform Code of Military Justice (UCMJ) is Uniform... as in a standardization of the rules for the Army, Navy, Marine Corps, and Air Force. Once upon a time each service had their OWN "law"... ie "Rocks & Shoals" for the US Navy.

His role is not as a military member in charge of the military. He is defined as the commander-in-chief by the Constitution. Most of the military is defined under Title 10 of the US code and their laws are defined under the Uniform Code of Military Justice (UCMJ). In our form of government and by definition, the commander-in-chief is a civilian and civilians cannot be held under the UCMJ.

I hope that you are not one of these people that want to try him under the UCMJ. What crime do you want to accuse him of?

It's called the Uniformed code of military justice by the way,(UCMJ). No the President does not fall under it.

Yes it does! for instance, when Slick Willie was in office he tried to use a loop hole in it and it did not work. I can't recall which and when. Yes, yes it does....
