Absolutely....if you are working. A flex spending account or cafeteria plan or a section 125 plan is for employees of companies. Age is irrelevant, but you must be an employee of a company that offers them.

My gut tells me that you cannot, but there are other alternatives out there like a Medical Savings Account which is similar to a FSA.
