That depends on the age of the children. If they are over 6 years of age the courts will take their wishes into account. If you adopted the children legally then custody automatically goes to you but other family members have the right to petition the courts for custody. It also depends on the state you live in, I suggest consulting a lawyer.

How old is the child and how long have you been married? I'd say get to a lawyer to ensure your rights and the child's rights are protected. If he is mature enough to make his own decision then many courts will accept this and give you custodial rights.

Contact the courts soon. If you need to, seek help from Legal Aid. If the child is older (7+), his/her wishes will be taken into consideration during the custody ruling.

Have you legally adopted the child? Does the mom want him back? Unless you have adopted him, very little I'm sorry to say. If the child is old enough, he can petition the court to stay with you.

Well depending on his age a court might consider letting him stay. If his bio mother is not capable of caring for him, the court may also consider that too. If she is still legally a part of his life she has a right to him. If he happens to go back to her, maybe you two could work it out so he still sees you.

Did you adopt the child? If you did you can possibly keep the child. I hate to say it, but you need to talk to an attorney and see what the law in your area says can be done in this case...

I just wanted to tell you my aunt was married and he brought into the marriage daughters twins they were. well when he decided to leave her they wanted to stay with my aunt and she was allowed to. she talk to a lawyer. Start thier talk to a lawyer and find out if you can it depends on where you live and the laws that they have. hope it all works out for you.
