The pilots in the Brazil crash may be charged and I was curious what kind of penalty they could face

The pilots will face from 50 to about 120 years under Brazilian Laws. They wont get out in a hurry mate.

Involuntary manslaughter?!

It was a mid-air collision. By all means, the people on the Embraer shouldn't have survived either. But they did. Thanks to the evasion maneuver that the 737 pulled to get out of their way. The wing tip of the 737 hit the wing and tail of the Embraer, but sent the 737 into a death spin.

By all means, no one here should be charged with involuntary manslaughter. If anyone should be accused of anything, it's the pilots of the 737. Because of their act of selfless heroism, they spotted the Embraer first and avoided a head-on mid-air with the Embraer. However, a 737 isn't built to handle airshow maneuvers.

It's said that ATC has a role to play in this too, accidentally assigning the Embraer and the 737 the same altitude.

murder of planes is morally wrong, retiring them is bad enough.
