What are the penalties monetarily, as well as legally for overstaying a tourist visit to the United States? No visa, just a vacation.

Sarcasm is not appreciated. This is a serious question. Canadians do not need a Visa to visit, so let's stay on topic.
Thanks.

If you are caught (which you may be at the port of exit) you may find yourself on a ten year denial of entry list. If you are stopped for a traffic violation or similar you may even find yourself detained & deported.

The usual penalty for an overstay is being banned from coming to the US again for 3 to 10 years, depending on how long the overstay is.

sorry, the visa is not valid. There is no visitors visa which is valid for 3 years. Maximum is 6 months. So he is currently illegally in the US. But fortunately for you both overstay is usually forgiven if he marries an US citizen. As there aren't any other problems it should turn out OK. But file ASAP. You can find instructions on the USCIS website.

If you are deported you would not be allowed back for 10 years, and if you came back illegally you could go to jail.

I know there can be jail time for crossing the border illegally, but I am not sure about just overstaying.

If you don't do anything else wrong you would likely just be deported, though, the first time.

Penalties include being barred from the US for up to 10 years. Monetarily includes paying your own ticket back home.

Visa overstay is a civil offence, not a criminal one. If you get caught by ICE, they will detain you and set a court date to start deportation proceedings against you. you can post bail, somewhere around $5000.
