I was in a car accident in January(beginning) 2006 and had to go to the chiropractor until May(beginning)2006. Med bills came out to be $4000+, out of which my car insuarnce co.paid $2k for. The first offer made to me from the other persons insurance co was around $2500 after taking out the rest of the med bills I had to pay (out of pocket). I didnt accept the offer yet and sent a message to the claimer to see if we can negotiate, they have not gotten back to me; its been about a half week. Isn't it fair for me to ask for the P&A settlement offer to be at least equal to the sum of my med bills? Should I get a lwayer?

I'm not a lawyer but in my opinion the amount of P&S should at least equal the actual damages....but you are saying that your insurance paid part as well....in which case their company is basing the offer on the half they had to pay, and would sound fair in that case. I'd talk to a lawyer...as a previous person said, most will do an initial consult for free. Some personal injury lawyers can get more than you could get by yourself. Check it out.

Don't rush out to an attormey. That offer is pretty close to the value of your claim. You can't fixate on the amount of your bills. Are you out of pocket the other 2k? If so, then you should ask for that, and then a reasonable figure for pain and suffering (2k or 2500). But if you are not out of pocket on those, and if you're in a state that only pays pain and suffering, I'd ask for about another 1k, 1500, which would get you to 3500-ish. Four months and some change of chiro treatment is a bit excessive.

Definitely speak with a lawyer. Your initial consultation should be free anyways. If he thinks the settlement is acceptable then you won't lose anything. I believe the money should at least cover your bills though.

a lawyer is your best bet,, 2 settle now and you have problems later on from the accident, could mean you short changed yourself.. type bar association in your seach bar 4 lawyers..
