Is it true that when you ask a law enforcement officer the question " are you in any way associated with a law enforcement agency, local or federal?" that they legally HAVE to answer truthfully?

a lot of you are stuck on the "are you a cop", and i know that they can say no to that, because they sometimes go by another title, but really look at the exact wording I used, there is a reason for it. And to the person that asked if i asked this before, look at who asked it, two different people, just look at the names silly.

Undercover. Cops. CAN. Lie. Period, full stop. It doesn't matter how you word the question, they can lie. That's a Hollywood-inspired myth.

"Even though someone may have [sold drugs], as charged by the government, if it was the result of entrapment then he is not guilty. Government agents entrapped him if three things occurred:

- First, the idea for committing the crime came from the government agents and not from the person accused of the crime.

- Second, the government agents then persuaded or talked the person into committing the crime. Simply giving him the opportunity to commit the crime is not the same as persuading him to commit the crime.

- And third, the person was not ready and willing to commit the crime before the government agents spoke with him.

On the issue of entrapment the government must prove beyond a reasonable doubt that the defendant was not entrapped by government agents."

No, deception in the course of an undercover investigation or in a wide range of other interrogation or investigation circumstances is completely legal. There used to be some hair brained statute on the books somewhere in the US (maybe New York State), that a prostitute could ask that question and an undercover officer had to tell them if they were an officer or not, but it got struck down as soon as they got out of the stone age. Other than that, it's only something you see in the movies.

According to supreme court rullings police are allowed to lie to a suspect in order to further an investigation, so in a word no a police officer is not required to answer that question truthfully.

However an officer can not be misleading in other circumstances like brining someone in for homicide and saying well if you fess up we might be able to make a deal and get you off with speeding.

No that is not a true statement. It is true that when they are ggoing to arrest you then they have to say that they are police. If an undercover police officer is talking to a prostitute or a drug dealer and they ask if you are a cop there is no law that says that you have to tell the truth. If you were oing to sell me illegal goods and asked if I as a cop and I told you yes, you would not sell it to me would you?

Who ever told you that was mistaken.

No, this is just another "old crooks tale" and TV myth. The only place we have to tell the truth is in court and on official records. Other than that we can resort to trickery and deception to further the investigation.

Absolutely not. That would invalidate any undercover operation. In most cases officers can say anything they want true or not short of threats or intimidation to further an investigation.

first off all the goverment agencies are in cahoots and they are all friends entraptment doesnt mean anything when you are down town in the lock up, but if you have a good good CONNECTED lawyer you can get out of alot and i mean alot no matter what any one eles tells you, but all i can say is dont commit crimes and you have nothing to worry about

That would make the use of undercover police officers worthless. Can you imagine drug dealers and mafia asking anyone suspicious "are you a cop"? No one would ever get busted!

they can lie to you and its very legal in protecting their identity during the cousr of any undercover ops its santioned by the DA office and US attorneys chiefs and courts try to post it again and get same answers stay legal and don't fret about it
