dont know if you remember me but i asked a question a couple weeks ago about my ex holding the license plates and title to my car hostage.

anyway i went to the dmv and they told me there was nothing i could do but to get them from him. they wouldnt even give me a copy of the title even though my name is also on the title.

i called and asked him when did he plan on giving them to me and he didnt give a definite date but said he would be drop them off. its been a week and i still havent gotten them. i heard that he was waiting till just before my temps expire. i could pick them up but he is s truck driver and is gone when i am at work and leaves out before i get home. and i dont want any mess. why must people be so ignorant?

the car is in both our names but he knows the car is for my use. i pay the note and insurance.

no nothing was split up. im not trying to get anything transfered in my name only im just trying to get the reg. info so i can have it in my car and i dont want to ride around on my temp plates for too much longer. say i get stopped by the police, what do i have to prove its my car except for the purchase agreement and the application for the title?

if both of our names are on the title then both of us have equal claim to the car. he cant do anything with the car with my approval, he cant take the car.

Since both names are on the title, both parties will have to sign off on any ownership transfer...even from both existing owners to one of those people.
You need to get your attorney involved.

First, forget the police. They will rightly tell you this is a civil, not a criminal matter, and they won't get involved. You said both names are on the title, but didn't say how they were listed. If it is John Doe OR Jane Doe, either of you can sell the vehicle or make changes, like taking the other person's name off. If it says John Doe AND Jane Doe it would take both your signatures to make changes. If he is your ex, I assume you went to court and a court split the property and gave you the car you are trying to get the title for. If that is the case, go back to your attorney and tell him your ex is not following the court order to get you the title, and he will handle it for you.

Well, the truth of the matter is, if the car title and the plates are in both your names, he has full right to hold that title & plates.

You can have the DMV issue you a "duplicate title", but he'll have to sign off on that form, as well.

As to why he's being so difficult - sounds like he's trying to screw you over. Men do that sometimes.

i'm new to this.. why is he doing this? what's his athority on this matter?

is the car his?

if it's not then he has no authority... notify the police and ask them about this.. it may take an lawyer... i don't understand why the DMV didn't tell you these things? gee what do they get paid for anyways!

but start with the police.. just call the non emergency number and ask if you can talk to someone about this... and see if what they can do or what you can do and if you need them to stop by along with you to retreieve this then ask them if they wouldn't mind to accompany you.

if it's not his car.. or his name isn't on it in any way... he can't do this...

I would reccomend calling an attorney.

With both your names on the title,
he can come take the vehicle and there wouldn't be much you can do.

if your name is on the title as well just go apply for a lost title at the dmv...don't tell them anything other than you lost your title...probably about $6 or so....you will need your registration possibly...but don't offer anything unless they ask...have your vin# handy too...this is located on the dash...look on the drivers side through the window...have all of this handy...but don't offer anything except what they ask for...this should do it for you.

If the stuff is in your name just call the cops. He has no right to them.

Just report your plates and title stolen! You should be able to apply for replacements! DAMN MEN always have to make life harder for us women!! Get a friend to kick his a ss!!

call the police and get them involved. that's the only way your going to get them back.
