i have a trailor that my daughter and her boyfriend lived in it need some work her boyfriends family gave them a bathtub. it is currently in the trailor in use. but they broke up and now they wont the tub back and have filed a replevins. will they win

If the bathtub was installed in the trailer and it sounds like it was then no court would order it returned. You say they have filed, then all you have to do is show up and prove to the court it was installed and is in use and you will win. If they have filed in court for a bathtub that was a gift and they paid a filing fee then they are MORONS. The only way they could prevail is if there was a written contract to buy the tub and it was not paid for.

Replevin is a legal remedy, asking the court to order that certain property be returned.

The issue is who the tub belongs to, and who has the legal right to have it. That's something that will be determined in court. Once the court determines who owns the tub, it can either order one party to pay the other (monetary damages) or it can order the tub returned to the owner (replevin).

Who owns the tub is something that will only be determined at court, based on the available evidence.
