My husband did not sign for a certified letter because there was a W. listed as his middle initial and not an A. So the courts sent an order to appear through regular mail. The woman that filed is trying to get a restraining order on her ex. According to the paper work she really needs a restraining order on him to protect her son and herself. I called the court and let them know they had the wrong person. They said she gave our address(I think she must have got it from public records since we bought our home 5 months ago). They said that they would let her know on the 13th when she shows up for the hearing. Is this going to cause further problems for my hubby down the road? Oh, the papers also said the guy she was wanting was born in '78 and my hubby was born in '73. Thanks everyone.

If he misses work we lose about $175.00 for the day(he is a truck driver). Is there any other way to go about this?

Your husband really needs to do everything he can to take care of this misunderstanding. He may, by right, ignore the problem but will likely be subject to uncomfortable situations while the legal system sorts itself out. I'm sure your husband would be very embarassed if law enforcement showed up to take him into custody and threw him in jail until they could figure out what the confusion was all about.

Tell him to go to court on the day the hearing is supposed to be and request from the judge that he is not the ex. So that nothing further comes of this . I would think that the birthdate being different is cause enough but my husband went through the same thing . He was not an ex and had a totally different birthdate but kept being accused of not paying child support and was almost refused a drivers license because of that. So yes make sure he goes to court and gets a letter from the court stating that he is not this ladys ex. Good Luck.

As long as the middle name is different, don't sweat it. He might go to court on the day in question and request a letter from the court stating he is not the ex. Carry said letter in case the cops pull him over and have the name in their system.

It will show up on a public record such as criminal history or even checking a driver's license. The good thing is that it will show up on her ex. It will only show up with name, date of birth, social security number, permit number, etc. It will not show up on your husband's record.

you can tell your husband to go to court that day and talk to family relations, to get the hole thing squared away, and also the lady will see that it is not her ex. and it will clear his name and address. it is public record. good luck.
