My friend was driving and he got pulled over for DUI it was my car so they gave me a DWI allowance. I was asleep. My preliminary hearing is tomorrow...has anyone had this happen to them before?? Im freakin out cuz i dont want to have a DUI on my record...PLEASE HELP...is there anything i have to worry about or am i stressing for no reason?? Oh it was in camden county on the AC expressway.

I wasn't insulting you by saying you were a MADD i was just making a statment because you had probably lost someone...but if you choose to take it that way thats your decision...Drunk driving is not a wise decision and i wasn't asking the question to get a lecture on my life decisions...i am fully aware of the consiquences of my actions...i really just wanted some advise as to the saverity of the charge because i have never gotten a DUI before and wanted some advice from someone who had gotten one...On another Note i was not intoxicated or had drank anything when we were pulled over, I was asleep and i didnt know that my friend was drunk...SO stop hating and answer the question realistically!!!
I could have been an innocent person who was killed if we got into an accident too....

Get a lawyer. I have never heard of this, but I don't see how you can get into trouble for being in a car with a drunk driver.

Of course, MADD is a terribly powerful lobby. They shove tons of money down the throats of politicians to get their Draconian laws passed. I could see them passing a law stating that if you allow a drunk to drive your car, you are in trouble.

What can you do? If there is such a law, probably not much. However, you can write to every politician that represents you. Tell them how these ridiculous DUI laws hurt innocent people.

DUI is the only offense where you get in more trouble for what you MIGHT do than what others actually do. If you cause an accident and actually hurt people, you can walk away with a small fine and a few points on your license. If you get caught driving "drunk," you lose your license, your car insurance goes through the roof, you get fines of thousands of dollars, you must attend special classes, etc.

PLEASE write to your legislators and let them know that innocent people are hurt by these DUI laws - innocent people who vote. MADD can be defeated, but we must all ban together!

I don't see how they could give you a DUI if you weren't driving, but there may be something like an accessory or something since you allowed a drunk to drive your car. I've never heard of this, but I hope you have an attorney.

To Bharris - DUI laws don't hurt innocent people. Drunk drivers hurt innocent people and when your child dies after being run over by a drunk you will rethink your ridiculous "let the drunks drive" attitude.

Actually Lek, I am not a member of MADD, but I'll bet I'm a bit older than you and I have more life experience concerning drunk drivers. At the age of 21, I hit the windshield at 80 miles an hour in a headon collision while riding with my drunk boyfriend. Luckily the innocent guy we hit wasn't hurt, but I was and had several surgeries and months of recuperation. I have also had a schoolmate kill his brother while driving drunk and he never got over it. Nor did the guy who maimed the 5-year-old daughter of a neighbor. Drunk driving is illegal for a reason and if you don't learn your lesson now you will eventually get a lesson you will wish you had never gotten. Either you learn not to drive drunk or you pay the price for your arrogance. I know I did as well as many of my friends and I really hope you are smarter than we were although with your attitude here I really have to wonder.

Are you talking about DWI or DUI? Cause DWI is driving without insurance, which they are going to nail you for if your car wasn't insured. But I'm not sure how they can charge 2 different people with a DUI. Yes its your car, but he was the one driving.

Seriously though, I hope you take this as a "wake up call" (pun not really intended) that you need to be more careful with the decisions you make. Things could have gone a lot worse. You could be in a casket right now. Or someone else's father, mother, daughter or son could be.

Best thing is to avoid this kind of situation even being a possibility.

Although Camden County is a pretty busy county, you may be able to get a deal if you have a clean record.

Unfortunately it sounds reasonable. It was your car and you would be held responsible for who was driving it cause you had to have handed over the keys. Kudos to you if you knew you couldn't drive but if he had been drinking too then you would be held responsible. You could argue that you passed out and he took you and your car without your knowledge but i doubt it would work.

Yes, there are many states now that say it's illegal to knowingly allow someone to drive your vehicle while drunk. Find better friends.
