Just found out that my lawyer has not discharge a my bankrupty and wants some owed money. My falt. I want to get the discharge dated years ago so I don't have to wait another 6 or 7 years to clear my now good credit history. Is this legal and can he do this for me??

First let me tell you that the bankruptcy begins on your credit at the time of filing.... so when it is discharged it is automatically dated from the time of filing. Usually the attorney will file the debts with the trusty before you have him paid in full just to get things started. Since the laws have changed, you may have to go through counseling and present a certificate to the courts in order for them to discharge it.
Pay off your lawyer asap!! Your credit report is going to show the date of dicharge and there is nothing you can do about that, but, it will also show the filing date. Your good credit history after filing is the key to cleaning up your credit. I have filed twice in my lifetime and can write a book about credit... your current on time payments will clean up your credit so don't worry about that. It takes 10 years for the bankruptcy to come off your credit report. 7 years before you could file again and you can only file bankruptcy 3 times in your life so let this be a lesson you don't have to learn again.

Not sure about Canada but in the US, the court is the entity that sets the discharge date. Your lawyer files the paperwork and keeps the process going but it is the court that sets the discharge date.

Man, why doesnt he just let it go rather than trying to get blood from a stone. I mean most of them dont do any real work anyways, they just show up in court and read what someone else wrote for them. If it was some huge case and you owe MEGA $ then I can kinda see him wanting that money but he should just let it go.
