I know i know this was REALLY stupid but I asked the lady if it was going to go on my record, I didnt want to ask anymore questions, i was pretty embarrassed, but will I have to put this on my job applications? Im leaving to germany and im leaving to Germany with my fiance thats in the army and we are getting married in a couple of weeks, will the army say something about this? they also said that im going to pay double for what i took and some state fees and maybe penalties, does anybody know what this is and is this something to really worry about? They didnt arrest me, they said its a civil something, that I didnt need to go to court for it but will this make a criminal record? It was all about $17.00 or less.

If you weren't arrested, did you receive a citation (a ticket) or from the police? If not, it does not sound like criminal charges are being pressed.
The money they are charging you with is called Civil Restitution. Merchants are allowed to charge people caught shoplifting a fee in order to compensate for their expenses related to your theft (ie. salaries for security, etc.). That won't appear on a criminal record as it just as stated...Civil...just like other civil claims such as small claims court.

They are civil charges which is different from criminal, but check with the court clerk if you don't want to pay a lawyer to ask. It's good you're cleaning up your act because they may reserve the right to press criminal charges if you don't pay up or do whatever they ask, so it's good you learned your lesson.

Everyone makes mistakes. Forgive yourself and don't do it again. After you do your homework and pay up, put it in the past.

Was there an offense report taken.Y/N If yes then it's a criminal case..if no than you're lucky. If you received a citation than is a class C offense Theft < $50. you'll be OK.
If no police action occurred than it might be a civil issue...no criminal record.

Unless you are convicted, it will not go on your court record. Now, if the military wanted to do an extensive check on you, they could get that information, but not anyone else. Another thing, you might want to work on your inablility to buy things, they don't take that lightly in Germany and you will serve time in jail for that.

Beware of this. Lots of stores will tell you they will take a settlement similiar to what you have said to get you to admit guilt and then they will press charges anyway.

BUT, if charges are laid and it is your first offence the Crown Prosecutor could still decide not to proceed.

I hope you are not in the USA. If you are you will have a criminal record because shoplifting is definitely a crime in the USA. It will go on your record then.

don't stress it. its petty larceny any where you go. the worst that will happen is that you will have to agree never to enter their store again. civil court is not criminal court. you get sued in civil court you go to jail in criminal court.

Shoplifting is a felony crime. But you can beat it depending on how much you stole and past arrests.
