Funny question i dont go out often BUT always after a few drinks get take out to take home (6 children waiting for us) so when i asked the weightier for the take out menu he never came back and sent a replacement (we were at a table) so after ordering not only did i leave a 40.00$ tip i wrote a message on a napkin for the owner (one of my costumers at my Marina) no matter what situation you are in treat people the way you would like to be treated

Definitely you should have asked for another waiter. My guess is that no one had yet complained about this waiter (if they had he either would have straightened up or been fired). The manager would probably really appreciated the info, accommodated your request and maybe you would have even gotten free dessert! If the problem continued once the issue was raised, i.e. the manager also had an attitude or the new waiter had an attitude, I would have left and contacted the owner at a later time.

I would have to agree with asking for another waiter BUT the best to do would be to speak to the management about the situation then dine at another restaurant. Most people don't realize that no matter who/ how/ what happens....all the wait staff and cooking staff are connected ...to avoid any "messed with" food..it would be smarter to "complain and go"....it is always true in restaurant dinning....."never bite the hand that feeds you"
*Most busy restaurant waiters' salary in New York City is $65,000 and up...so, your money is not going to make any impart on their service behavor.

It does not matter if your spending $10. or $1000. That person is being paid to give you good polite service. If he thought there was a problem, IE unacceptable behaviour, dress code violation, non-payment of bill, it would be the managers problem to deal with. Not a waiter. YOU should have complained to the manager.

i have been to restaurants and had to ask for a another one. jus ask for the manager and then let him/her know the situation and ask is it possible to get a new waiter. most managers will do everything they can to prevent business from walking out the door

I would've definately asked for another waiter. I've done it before. You're supposed to ENJOY your dining experience, not be upset or uncomfortable in any way.
