I was involved in a car accident approximately one year ago. The other driver was found to be at fault. I had approximately $10,000 worth of medical bills. What is a reasonable settlement amount I should ask of her insurance company?

Addendum: It was a low back injury and neck sprain. I had physical therapy for one year (as much as my insurance would pay). I am 27. My back is doing better, but still hurts after certian activities, but I am told that I could have exacerbations for quite awhile. I am a self-employed medical transcriptionist so it is hard to prove my missed work.

We need more info. The amount of your medical bills is not the determining factor. How old are you? What kind of injury did you have? Have you been injured like that before? Any other complicating health factors? What kind of treatment and for how long? Did you miss time from work? How much? Don't listen to anyone who says three times your medicals. That is not the case. You could get less or even more depending on what you're dealing with. And no figure anyone here gives you will be what you end up getting paid. All claims are handled case-by-case. There's no set value.

Addendum- First of all, a year of treatment for a sprain/strain is excessive. Soft tissue injuries usually resolve with NO treatment in 6-8 weeks, 12 worst case scenario. That is going to be your biggest hurdle settling this claim. Forgoing your wage loss, knowing it's just soft tissue, you can probably expect the pain and suffering to break down this way- 1-2k for the first month, 500-1,000 for the second, 500 for the third, and then- if they are nice enough to consider the other 9 months, about the same. I've handled claims for 16 years and I have never considered a full year of physical therapy for someone who didn't break something, have surgery, or both. To compromise, they might throw you something like 7500-10 if they really, really want to work this out with you. Basically though, this kind of injury is worth about 5k (assuming we're dealing solely with pain and suffering).

10K in bill for a back sprain is WAY too much. and depending on your state, you may have to pay back this money with the settlement you receive from the other person's ins co. Therapy for soft tissue injuries is ususally 3 months max and if there is no improvement, you should have seen a orthopedic doctor for tests. Honestly, you will be lucky to cut even, and your bills could = or be less than the policy limits the other driver had.
Best bet= talk to the adjuster, see what they want to offer you, it could be more than you expected, or it could be that they feel that you overtreated and will give you a portion of your bills.
IF you get an atty, his money comes off the top 1st, then the bills, then you get the crumbs left over if there are any.

Cops are not going to help cause this is a civil matter. Unless you live in one of the few states were you do not become an adult at 18 and the settlement money was paid to you, then he should have no control over it and your only option would be to sue him for the money. Sounds like he is using it to control you and unless your education is being paid for out of it and there is no signed contract where you gave him control of your money, it should be yours to do as you please.

For God's sake, listen to Chris on this one. You are getting a lot of (the usual) bad advice here. 10K for meds in this climate of looneytoons medical costs is not really that much. If (and I hope) you are getting well and will make a full recovery then try to be practical -- slamming the other parties insurance company for revenge won't get back at the driver. Follow your head vs your heart and remember...lawyers ALWAYS get their money no matter who wins.

You need to consult an attorney to be sure. Ideally, you'd have worked with one from the date of your accident, but maybe something can still be done. Don't wait a day, though. Statutes of limitations may be ticking!
