It all depends on what the case is. First, my advice for anytime you are dealing with any govenrmental agency in an adversary situation (police, CPS, IRS, things like that) is to get the best lawyer you can afford.

CPS has the assigned duty of protecting the children of the state. They do this in many ways, such as taking custody of the children if they are in danger, or prosecuting people who abuse or neglect children.

If they are trying to take your child, you might be able to work out an agreement with CPS. In this type of agreement, you will agree to a set of conditions having to do with your parenting skills. In return, CPS will leave the child with you, or return the child after some conditions are met. If you cannot come to an agreement, you will need to get a lawyer and prepare for a court hearing. The judge will then decide what you need to do, if anything, or if you lose custody permanently.

If CPS is charging you with a crime such as abuse or neglect, you need to get a good attorney immediately. In this case, you are not fighting CPS as much as the local district attorney. Be prepared for an expensive trial and jail time if you lose.

To get more help, you will need to post more about the situation. I am posting a link to the Texas Family Code, as a starting point on what CPS can do.

Money and tons of it . this state has no control over CPS. children die on a daily basis while in the custody of the state . yet the state won't even pay for the burial for the children they murder.
many of what some have been called American terrorists , others might call patriots, have had the right idea! we as citizens of Texas should take back our rights by voting for the right people , petitioning , demanding in vast numbers so we cannot be ignored to over haul the systems that we let "run" our lives.
We MUST get involved, apathy is the down fall of our people. Black , White, Hispanic, Asian, we must join together as a State, to protect our selves from "THE STATE" . remember :" We the People in order to form a more perfect union." The People , ARE the Government, we have just let a few rich egotist get a strangle hold on the power and they do not, DO NOT, want to let go. Power is a huge aphrodisiac. Save your selves ,and save your children , and your children's, children's, children. GET INVOLVED. and I must practice what i preach , so i must get more involved. time!?, we have to make time for everything, only 24 hours in a day , who knows when ours is up. use it wisely.

The truth doesn't matter. In my case, the judge agreed the CPS had not proved their case. Yet he gave them custody of my child,

First off, you don't commit the act for them to be called. Sorry, but you don't allow your children to be put in harms way, nor do you stand back and allow it to happen. Good luck.
