I just found out about this.. but a few weeks ago my mom got a check in the mail from a online lotto place for $2,000 and she cashed it. Well a few days ago she got a phone call from the store she cashed it at and they told her it was a fake check (counterfit), and told her the police was going to picking her up and the Attorney general was getting involved she called and left a mess to see whats going on but nobody has called her exept the store owner where she cashed it.. ok the question is could she go to jail?

Seems strange. If the authorities haven't contacted your mom yet, the store owner may be just trying to scare you both. I wouldn't worry about her going to jail as this can be straightened out. It's not like she deliberately cashed the check knowing it was fake did she? Anyway how does anyone cash a so called fake check? The check should say on it "non-negotiable" if it wasn't real. Keep making phone calls to the authorities and maybe talk to an attorney if possible. Who ever cashed this check(store employee) should be contacted as well. It would seem that the worst that could happen would be to repay the amount.

It could be a scam from the store owner. If the check is indeed a fake the police will contact her.
I don't think she will get in trouble, if she truly thought the check was real.
I would definately not go on the store owner's word. I would need more proof than that. They may tell her that trying scare her and get her to fork over the cash, and then nothing happens.
If it is really a fake check she will probably be allowed to re pay the money to the store.
Don't give the store any money until someone from the US attorneys offic or police dept tells you to do so.

Mothers, too, can be naive. Mothers, too, can be needy. I imagine that she'll have to be responsible for the counterfeit $ (be thankful it wasn't a lot more!) -- maybe she can handle paying it off in small amounts, or try making a deal with the Attorneys that would keep her out of jail. It's really tough being so trusting and naive. But I rather imagine this experience will teach her what NOT TO DO THE NEXT TIME. But this lesson was probably one neither of you wanted to learn, right?

Encourage your Mother to get an attorney. He can answer all of your questions for you and help your Mother in dealing with this matter.

Better get a good lawyer. If she didn't know it was counterfeit then she shouldn't worry. How come the place where she cashed it didn't notice that it was counterfeit ?

I don't think so, but she should repay the money. Unless, of course, she knew it was fake, then yeah, that's called fraud, and it is punishable by prison.

If it was really a fake, then the store manager should have known at the time when he paid her out.
