The guy who lives next door to me is steadily losing his grip on reality and I think he's going to do something harmful to someone soon. He's already threatend to burn the other neighbor's house down, he drives around spitting on people, constantly yelling obsenities to anyone, calls all the girls in the nieghborhood sluts and whores, and now he is obsessed with me. I caught him going through my trash, and he waits for me to come home and hides behind his fence and hisses like a demon. He does not work, has no friends, house is paid off and he drinks everyday to excess. He also spouts off right wing propaganda so....probably has a gun. We have gone to the police several times, and they warned him initially but now they won't do anything because they don't really want to get involved since he is on his property when he does these things. He never threatens...he just f/u's us anytime we are both outside, making it extremely difficult for my wife and I to enjoy our home. Help..

Start by calling your local Justice of the Peace and see what is involved in swearing out a Mental Illness Warrant (or the equivalent of that in your State). In Texas, that will get them picked up and put in a State psychiatric facility for anywhere from a 24-hour to a 3-day holdover and psychiatric assessment. They cannot fool the intake psychiatrists, either. They'll know if they've been brought to the right place.
Sounds to me like the man has gone waaaaaaay far away from center and needs some help. That or he's off his meds!
In Texas, you have the right to peaceably enjoy your property. Sounds like this guy has removed all the "peaceably." I would also go down to the Police Station and demand to talk to the biggest hat in the place. If that doesn't work, take it to the Mayor.
The more evidence you have such as videos, audios, photographs, etc., the better your case is going to be.
Sorry for your troubles. Sounds like you're nearly living hell on earth.

Call your local department of social services. They may have an Adult Protective Services division that could be of assistance. It sounds like the man has a mental illness along with alcoholism, but something needs to be done.
Harrassment isn't allowable. It doesn't matter that he's on his own property. You might be able to get a restraining order, but the magistrate might listen to the story and only allow a "no trespass" order which won't accomplish much since he's not coming onto your property.
Actually... if he's becoming obsessed with you, digging through your trash and waiting for you to come home so he can hiss at you etc, that might come under the "No stalking" laws. I'd continue to visit the police department or speak with an officer who handles stalkers (don't recall the division) because you may have enough to press charges against him already... for harrassment if nothing else...

I would borrow or buy a video camera and tape him everytime he does something offensive. You can still file assault charges and take him to court.
You should also be calling the police EVERYTIME he does something and get a report on it, in order to take the report to court with you.
He may have a psychological problem and be harmless, but if he ever brandishes a weapon on you, you want that on tape or have proof of it with a police report. If you go to court and the Judge finds he has a psychological problem, he can order social services to get involved, which may place him in a group home or an insitution. Sounds to me like this may be the case.

OKAY. First of all, you are no better than this guy. Keep that in your head. Second, just because he's 'right wing' doesn't mean he owns a gun.
Have you called the cops? Have you documented cases of odd behavior? Have you taken pictures of him going thru your garbage? They can (for HIS own safety) take him to a mental institution if he needs it, or jail if they feel he's broken laws.

If he is spitting on you that is an offense called "assault." You should press charges against him and then sue him for disturbing the peace.
Talk to Judge Judy about humiliating the pants off of this pervert.

Wow, that's excessively creepy. Get lots and lots of documentation of him doing weird things and bring it to the cops next time. If he is a danger to the public, he should be committed somewhere.
