When you go to court, I can only speak for Ohio law, the hearing authority can grant you driving privledges for work and most do, the fines and penalties however are usually not going to be waived but might be reduced depending on how the case is presented. Most likely you can get into a re-hab program of some sort to avoid spending actual time in jail.

Everything being in total, get a lawyer and for goodness sakes don't ever drink and drive again.

If convicted it would've included loss of license (3 mo. - 1 year), fines, court costs, court-ordered DUI Education, the start of a paper trail for such drug offenses. Driving is a privilege and not a right so when you sign for your driver’s license you agree to take a Breathalyzer and when you refuse to take them you lose your driving privileges for up to a year in most states.

What will happen is hopefully you will realize that all DUI accidents or and their accompaning punishments are 100% preventable and that your deluded feeling and belief that you should be entitled to put our society at risk simply because you wanted to go from point A to point B without having to wait till you sobered up was more important than the health and safety of our families and personal property. But, what the Hey ... having to take public transportation will give you time to read or other worthy pursuits.

Welcome to the wonderful world that MADD has created. You are now in more trouble than someone who actually gets into an accident and hurts someone. DUI is the only law where the punishment for what you MIGHT do is much more severe than the punishment for what someone else actually does. Lovely, ain't it?

I am unfamiliar with the Illinois laws, but because MADD is such a powerful lobby, they've probably managed to get the laws in your state to be the same as most others - mandatory sentencing with no hope of leniency. Do not waste your money on a lawyer - you'll need it to pay the outrageous fines, and there is absolutely nothing he can do to help a first-time offender.

What you can do is write to your politicians - over and over and over again. Explain to them how these Draconian laws really hurt people. Detail every single problem that this conviction is causing you, AND be sure to find other stories in your state of people who have caused accidents and only received a fine or some other silly punishment. Ask them why someone who has actually caused damage and/or injury is in less trouble than you are.

I can't tell you what is going to happen, that is totally up the the judge. I would of not refused to blow for the P.B.T though. I am taking classes on law enforcement. If you refuse to blow, they will arrest you anyway. Say you do blow though, and you get below an 0.08 they will not make the arrest, so it really is your only saving grace (just to let you know for the future.) Just don't let it happen again, DUI is so dangerous, not only for you but people all around you on the road. Imagine if you would of killed someone totally innocent. I wouldn't be able to live with myself. Anyway, back to your question, your record is pretty dirty now, just don't let it happen again!

Sorry, I really don't have much sympathy for you, but you are almost definitely going to lose your drivers license. You will get a nice hefty fine and this will be on your record permanently. You should just be happy that you DID NOT KILL SOMEONE!! You are 29 years old, not a child. You acted very unwise so now deal with the consequences like a big girl!

Well, you lost any chance you had to keep your license by refusing the Breathalyzer. You may do jail time, you may not....but you will most certainly lose your driver's license for a longer period of time then if you would have done the Breathalyzer....because you refused, it is as though you had the worst blood alcohol level.
DUI are designed to hit you where it hurts most, y our pocketbook, so besides the money and the loss of your license, you will most likely have to do community service and attend highway safety school....you are screwed...and i don;t feel bad for you either. Learn something from this.....don;t drink and drive..you can;t afford it!!!!!

Sorry, kiddo! No sympathy from me on this one. You should have thought of that before you got behind the wheel. You not only endangered your life but also the lives of anyone else you might have hit if you had not been stopped. I know a guy that was driving and drinking and he ran a stop sign. He hit a car and the girl in the car was killed. He spent 10 years in prison with no parole. So, consider yourself lucky that you were pulled over before you found yourself spending ten years in prison. Could easily happen, you know.

Find a lawyer who handles DUI. If you try to deal with it by yourself, you'll get the max.
