My husband and I met, fell in love, had a church wedding, he's 51 and I'm 57, and all we want is to live out the rest of our lives together here in America.
We went to our marriage interview on March 15,2006. 4 days before our 1st anniversary, our marriage was approved but they handcuffed my husband and took him away. Said he had overstayed his visa and had a final order of removal. ICE has had 2 sets of travel documents for my husband to be sent back to India and they still continue to hold him in jail. My husband is not a criminal and has no criminal record of any kind, not even a jay walking ticket. If you go to ipetitions on immigration you'll find a lot more info on our case. lonely_spouce

My husband came to America 12-18-2001 and filed for political assylem 2-2002. Had an attorney in CA. 1st judge denied his case, can't win because he was hindu and they can't file for political assylem. He got another set of attorneys in San Francisco, refiled, next judge dismissed his case in 2003 after he had been transfered to OK. by his job. I met him as a customer, started talking, then dating, then married. We went to Ca. to his attorneys for filing the I-130. His Attorney told us all is well and nothning to worry about, so we came home and waited. We were so happy when ICE sent us our letter for the interview, we could finally go forward with our lives and start our own business and I could get off the road after 36 years of professional driving cross country.

It would seem that he overstayed, and that he had a deportation order against him. Marriage to a citizen does not stay deportation. And he may be banned for ten years. Your "interview" might have been a trap. I wonder whether you consulted an immigration lawyer. There is a lot of information online, on lawyers' Web sites, on this sort of thing happening, on the risk of dealing with USCIS directly in sensitive and irregular cases.

You might be left with the hard choice of living with him in India. Or Canada or another country.

sometimes the people right next to us can be the ones we know the least. There may (must be) some thing more that you dont know about. They wouldnt detain him for no reason at all- They may how ever make a mistake. Just because we are all human. Just get all the facts together and be ready to stand by him in case he has to fight for the freedom you feel he deserves. Just wait and pray- it will all work out.

Well being married to an american citizen doesnt make you a citizen if only it were that simple for the illegals. Your husband should have gone through the proper channels to stay in this country.Im sorry you are lonely but you really brought this upon yourself.

They are just doing there job the way they feel fit, Its too bad they singled him out for nothing better for nothing, Why don't you live in India after all the residents say how fabulous it is to be there.

your marriage interview saved us tax payers money sure it was ruse to get him He broke the law you as an American should have seeked out better information prior to and after the marriage to legalize your husband sorry ICE did the right thing... Our immigration polity is nothing more than an atrocity. It as another person stated "A Little Hitler". I feel so sorry for you. They should release him for what reason are they holding him. Get a lawyer
