Can I get him deported if he doesn't pay up or throw him in jail? I'd rather not do this, but it's a dog eat dog world. I don't have time for this b/s.

I liked rx8 slotcar's question. I take it that no cops came? Who owned the vehicle? Did you see a legitimate registration from your state's motor vehicle department? Was there a valid sticker on the license plates? Were there license plates? Did he have any ID at all? If the registered owner (R/O) is not your accidental tourist, you can recover your damages from the registered owner, who would also be in deep water if he doesn't have auto insurance either.

If your R/O is an undocumented resident (illegal alien), I'd want to know how the DMV registered a car to someone without a proper driver's license. If he had a driver's license and was the same status, how did DMV let that happen?

Depending on which state you are living in depends on whether you will get action from ICE (formerly INS). If you threaten him with deportation, he will disappear into the wind, and so will your chances of any recompense. If you call ICE, they may help you get your money back if he has any to give. It just depends on whom you get on the other end of the line and how much of a law-abiding straight-arrow guy you come off as. If you get belligerent, I can guarantee you the file will be looked at sometime when they are not pressed with more important matters, like who's turn is it to go get the coffee.

The same thing happened to me. I had my car for a month and the one day BAM my car was crushed by and illegal who was driving his brothers truck and didn't have a license or insurance. I sued him and his brother and got every penny back for my car.
So you want to blackmail an illegal citizen into paying money that you are rightfully owed...The illegal could sue you for blackmail.
Just file the small claims papers and sue him for the loss of your car.
Yes, it's risky, you may never see the illegal again, but there's a reason they're here. They want a life and the American Dream.
The INS gets calls all the time, are they especially going to come out when this guy fails to pay, probably not.

I can imagine how frustrated you are, but the INS doesn't do anything about illegal aliens. The best you can do is to report it to your insurance company and the DMV. The DMV will suspend the driver's license for a year...and if the driver doesn't have a license because he is an illegal alien, it's possible that the police will take over from there.

The INS is waiting for your call. They are not busy at all, and would be glad to toss this guy out for not having insurance and being here illegally.

Report him...but it wont help much. The INS doesnt really do anything unless it's a gross violation of imigration laws. Like an employer with illegals. But if I were you I would take him to court to get my money. Try to get your money first.

You can report him, but most likely nothing will become of it. We have the same problem in the area where I live with illegals. Even our local police say when they report to INS ppl, nothing happens.

Your screwed. I'd call INS. I'm sick of people being here illegally. We Americans get the raw end of the deal.

He won't get deported. The immigration rules are something to laugh at. Basically you can report him and then when they file for citizenship they might get denied but that won't stop them from being in the country anyway.
