3. Killing yourself. Which in my opinion is the lesser of the evils for drunk drivers. If you haven't noticed (I have as I work for public safety 3 years sheriff's department 4 years fire department) most of the people who die in drunk driving accidents are not the drunks, but the people innocently crossing the street or sober drivers who are just unfortunate enough to be on the road with a drunk driver.

The judges view was he could have avoided the accident(which he could not have regardless of his condition) were he sober. I think the poor idiot spent about all of his life in jail; for dui.
