It depends on whether you're talking about the United States Supreme Court, or an individual state's court system. The U.S. Supreme Court is the highest court in the land, and it is the ultimate decision maker in matters concerning constitutional law. Each state has its own court system, and some of them have a "supreme Court", which is the highest state court. In other states, like New York, for instance, the "supreme Court" is NOT the highest ; New York's SUPERIOR Court is the highest court they have.
