It doesn't appear that anyone in the leadership had any knowledge of the emails. However there is a guy on the Congressional Information Technology team that did see the emails and did not report it because it is illegal for him to be viewing private emails.

According to USA Today, it looks like the FBI may be charging him with invasion of privacy.

As a legal matter, I'm not sure ... but as members of the "jury" of voters, it is up to us to remove those from office who do not represent our views.

I think that there should be a bi partisan investigation and if laws have been broken then they should go on trial.
