My brother and myself started a computer consulting company back in 1998. The IT consulting business has slowed down a lot, and we lost our last contract a few months ago. We have accumulated 15k debt on business credit card and a collection agency is harassing my family.

The company has been incorporated ( S-Corp ) since 1999 and the credit card is linked to the business and not our personal credit. The company is completely belly up with no money left in the checking account. No money. No assets. Can the creditor sue me personally? Will the creditor sue my S-Corp which has no money? Should I file bankruptcy for the S-Corp ( incorporated in Wisconsin ) any thoughts about how much that would cost? Thank you for any help or advice.

I encountered the same problem with a s-crop salon I bought for my exwife. My accountant says it like this.. if someone sues your company you are protected by the corporate veil so they cant come after your personally however any vendors or creditors can sue you personally. so to me I understand it this way .. if someone was to sue you because you consulted them wrong they cant come after you personally if its a creditor or vendor yes they can even if you didnt PG anything . I think you should talk to a attorney because im giving you hear say here..Hope it helps a little..
