Driving While Intoxicated is operating a motor vehicle with a blood alcohol level that equals or exceeds your particular state limits. Driving Under the Influence is when your blood alcohol level is below the legal limit, but your driving has been affected in the opinion of the officer who issues the ticket. That particular charge is an attempt to deal with persons who are not actually drunk, but whose driving ability was demonstrably hampered by the alcohol. DUI can also be used for persons driving under the influence of drugs which depress the nervous system- which is why you see the warnings on medications that will cause drowsiness or impaired ability to concentrate on tasks. If you take these drugs and drive, and they discover you were on medications or illegal drugs at the time, this is what you will be charged with.

For all intents and purposes its the same thing. I think DUI, driving under the influence covers drugs and DWI driving while intoxicated covers alcohol although it may depend on which state you live in as to which term they use as you could really use them both as a generic reference to alcohol or drugs.

Basically, the severity of the offense. DWI (driving while intoxicated) is where your blood alcohol level (BAC) is over the legal limit. DUI (driving under the influence) is where your BAC is under the legal limit, but you are still driving impaired. The same comparison works for other impairments.

DUI is a more general charge, (driving under the influence) covers any drugs and alcohol.DWI covers alcohol.(driving while intoxicated) Most states have changed to charging everybody with DUI.

its all the same i know someone who was arrested for driving while drunk and got a dui and the other person was high on xanax and they both were charged with dui dwi is the same

It is merely semantics. Different states use different terms , for instanced in NY there is no DUI legally, it is either DWAI -driving while ability impaired or DWI-driving while intoxicated
