Your assigned punishment is an order. According to AR 600-20, Para 4-2. "All members of the military must strictly obey and promptly execute the legal orders of their superiors". That means they can give you another AR-15, court martial you , or throw you out of the Army with a Chapter -14 (Bad conduct discharge).

An article 15 is a way for a commander to punish their troops instead of sending them to a court martial. For instance, a person in my squadron was caught drinking under age. Instead of turning him into the police, our commander gave him an article 15 (which is legal punishment in the military). This person had a reduction in grade, had to pay a fine and was ordered to do community service for 2 months.

Our commander decided this punishment was acceptable because she didnt think the offense was horrible enough to have him arrested and then court martialed. By giving this out, it was the commanders way of saying, "O.K. you screwed up. I dont think you did something bad enough to warrant police intervention, but you still need to be taught a lesson".

Now if a person just decides to say, "screw it, I dont think the commander knows what shes talking about, I'm gonna do my own thing despite what she says", that person could be in deep crap. Then, certainly the police will be brought into action, and something that wasnt supposed to be a bad thing for you could turn in to jail time and a dishonorable discharge.

Court Martial or another Article 15. I had a guy that was E-6, went UA for a month.
1. Art. 15, reduced him in rank to E-5 and gave him 45/45 loss of half months pay for 2 months

2 days later after refusing to work

Art. 15 reduced to E-4, 45/45 half months for 2

2 days later he refused to work and disobeying orders

Art. 15 Reduced to E-3 etc, went all the way to E-1 and then got court martial ed cause he started telling the crew members they should seize the ship and toss the officers and Senior non-coms in the ocean. I enjoyed slapping him in irons.

General Court he got 5 years hard labor, forfeiture of all pay and allowances, dishonorable discharge.

He had had 14 years in, what a waste.

You'll get another Article 15, at least, building upon your record of bad conduct. Give them enough reasons to, and they will kick you out of the military. Perhaps with a less than Honorable Discharge that would follow you for the rest of your life.

i got an article 15 when i was active duty in 1993 for underage drinking. i had 14 days extra duty, but if i didn't comply then they would enforce the max penalty and make the suspended punishment permanent...i.e. the money and rank taken away.

what are you looking at nailed it. You will be charged a second time, more than likely be kicked out with a dishonorable discharge, and maybe spend time in jail. Just in case you don't know, if you get a dishonorable discharge, you will be lucky to get a job of any kind. Good Luck to you.
