I am American and my partner is English. My boyfriend and I have been together for three years, living together for one. We currently live in London where I am staying and working on a 4 year work permit. My boyfriend works in IT and has a master's degree. We understand that the US does not allow defacto immigration. Is marriage the only way for my boyfriend to get a visa to live in the USA with me? Also, if we did get married in the UK, how long would we need to wait before moving to the US and would my boyfriend have free right to work when we arrived?

The first thing to do is contact the US consulate, its in Grosvenor square, I was in a similar situation some years ago and the only way was to get married, however I was allowed to enter the country (US) on a J2 visa which is a fiance visa, but even with this I only had 3 months before I had to get married. I was able to work after id received my temporary work permit. hope that helps good luck.

Let me answer this since I do this for a living.
Unless there is a U.S. based employer who is willing to petition for him on a work permit your only option is to get married.
The classification the other guy was talking about a J2 (thats the dependent of a J1 which is an exchange student or worker) is not what you need.
Contrary to what most people believe it takes less time to get a fiance' visa (K1) than it does to get a visa for a spouse (K3).
Times are usually 9 months for a K1 and almost 3 years for a K3.
And thats only to have it approved which means that your boyfriend would have to stay in Great Britain until approved.
Your best bet is to petition for him as a fiance' of a U.S. citizen which is the K1 visa.
You can go to www.cbp.gov and find the forms you will need on there, off the top of my head I know you will need an I-129F and a G 325 plus all the supporting documentation showing that you are together (they want to rule out marriage fraud).
Once the K1 visa is approved you have 6 months to get it processed, meaning he has 6 months to make entry into the U.S. as a fiance'. Once the K1 visa is stamped you have 90 days to get married, once married he can work anywhere he wants in the U.S.
Just remeber that once married he will be in adjustment of status meaning that he will be going from a K1 visa to a permanent resident (Green card as most people call it) so he will not be able to leave the U.S. until that is approved. If there's an emergency and he needs to leave the U.S. before becoming a permanent resident then he can apply for a travel permit through the immigration office in the city you will be living in.

Defacto Immigration??? Your boyfried may qualify for a variety of visas, H-1B, L-1,etc. The problem with the H-1B right now is that he cannot get one that will start before Oct. 1, 2007. You should see if his current employer has an office in the US that he could transfer to.

If you get married in the UK, it takes a lot longer to get him here. Instead try a K-1 fiancee visa. It makes you get married within 90 days of his coming to the US, but he is eligible for work authorization.

I went to the USA on a business trip and after being shown around the States I was taken to a three level five bedroom house outside Kansas City.
Then I was shown a brand new plant that they wanted me to manage.
The house and the job was mine.
It was a major USA company and they had no worries about my working there as an Englishman.
They were going to fix everything including moving me and my family.
It never happened because I would not compromise my family for money.

So yes it is possible unless there is a different law for companies.

The problem is that anyone can stay in the uk,however its a different ball game in the states.They simply dont care about people from the uk!
