All of the named presidents became president well after any "act of Congress from 1790 through the Civil War" ...The question is a bit confusing. An "act of Congress" wouldn't be the name of a president.
(Maybe you inadvertently put the list of multiple choices with the wrong question? Is that possible? If so, come back and edit your question.)

For your second question I would choose D. Unfunded mandates drive government leaders crazy.

The first question doesn't make sense. It asks for an act of Congress, but lists former presidents.
