Is he paying for your cell phone? If he is,he has the right to take it from you. If he isn't he doesn't have the right. Break up with and call the police and report the phone stolen.
Either way, he is being too controlling.

But mind you, if you actually flirt with other guys on the phone or give him a reason to doubt you then it's no wonder he did it.
