Both can be construed as crimes. As in usually, one would have to seem to be up to something to be noticed in the first place, if no direct answer that makes sense to be there in the first place it becomes suspicious. I wish I could say generally this would be an easy find, often a crime can be committed before the perpetrator is caught. yes, they are crimes. To what degree, could be stalking which is very serious. Or waiting out a situation for burglary. both, indeed are crimes.

usually the local police just ask for you to move on and thats about it. signs are posted in the areas. look around and you will see them. pedple dont like loiters around buinesses after they have closed for the day

It's a crime to do both, both have specific penal codes. Also, with either, there is an implied intent to commit a crime. =)
