It is really hard to tell what is fair without knowing the FULL circumstances. Being issued a citation is legally an arrest, however the subject is cited, released, and given a mandatory court date instead of being booked and given the same court date anyways. Depending on the state, police can't arrest on misdemeanors not committed in their presence, battery is a misdemeanor. In this situation a cop can file with the D.A., or the victim can do a citizens arrest, usually ending with a citation for the suspect. The fact he was given a citation over an arrest does not change the severity of the punishment if he is found guilty.

In california, even if someone got hit, it's a misdemeanor if there was no serious injury and a citation is appropriate unless the officer felt that the violence would continue and then they can take them to jail and have them cited out there. However if there were serious injuries requiring hospitalization or stitches then it would be appropriate to have them jailed and set bail.

Hate to disappoint you, but that's standard behaviour in any court. The perp is, in the eyes of the court, innocent until proven guilty. Bail is normal UNLESS the DA can dream up some reason why the accused would not appear.

That's just the way it works. It's all who you know or are related to.
Someone in my town just got in an accident with no license or insurance or anthing. He was illegal in every way. After he got out of the hospital he got a $200 fine. Because of who he is. If it were you or me we would have been in a whole lot more trouble than that.
If you don't want to get in trouble, make sure you know the right people or you are one of the right people.

Of course, he got his buddies protecting him.
In my town, a police officer's daughter got rebellious and ran away. For every other kid who did that, they added his name to a list and just kept "eyes and ears open" to see if they spotted the kid somewhere.
What was done to this officer's daughter? Oh, he got his good buddies, detectives, and everyone he could to trace his daughter in another state,, and bring her.
