Could we do all the INS process here in the States ? How long do you think it will take & what pettion should we file ?
I was on a marriage visa with my eX husband & had expired before our divorce (additional detial).

If you marry a US citizen you cannot be deported. I suppose you could be exiled for some kind of heinous crime, but not deported. As ridiculous as it sounds, citizenship in the greatest country on earth can be had for a song and dance via:

(1) Marrying a US citizen regardless of the money you might have paid to the spouse in a deal to get citizenship
(2) Just being dropped out of a vagina on US soil.
(3) Sneaking across the loose borders and just living in the US for several years is usually enough as well.

A few people actually go through naturalization where they have to learn about US History and take an oath of citizenship to get all of the benefits but that seems to be the rarity. I have a German friend with a doctorate in political science who waited 12 years to become a US citizen the legal way while we grant 100s of Mexicans residency each month who snuck in through Arizona and can't even speak English. So God Bless Anyone who can set foot in our nation! Welcome to the citizenry!

go check the us immigration and citizenship website no longer called ins, but ice, you are out of statue therefore subject to immediate deportation. you may have a small small chance but more likely you will have to leave for 3 yrs to be able to come back.,

btw if you marry to stay in the us the law now says you must stay married for seven years.

no quicky marriages. if you do not follow the rules since 911 they throw the book at you.

Very smart russian you are, coyly comtemplating between K1 and K3, but you shld have been smarter to strived harder to make your first marriage work. I guess a sham in the beginning will be a sham in the end. Words of wisdom: Its a red flag for USCIS to marry for papers the second time around.

Your visa is expired. Maybe you will get deported. Possibly going back to your country and doing things over the right way would help.
