How else do you think insurance companies make money?!?!? They over charge and then its nearly impossible to get everything out of them. They should pay out everything that your policy says they're liable for.
Watch out for clauses and "excess" charges. The idea behind excess charges is that the more exces you opt for, the cheaper your insurance will be because it means you are liable to pay whatever the excess is and they'll pay the rest.
If they're just acting irresponsible then go see a lawyer - the insurance will have to foot that bill too if they are found to be breaching their terms.

Your insurance never pays 100%. Only the cost of repairs (or actual cash value if totalled) less the deductible. If they collect from the other driver's insurance company, they'll refund your deductible.
Discuss it with your insurance agent and they'll explain it to you.
If you live in a no-fault state, you're out of luck. Your insurance pays for your repairs less the deductible and you CANNOT recover from the other driver unless there are severe injuries involved

It depends on whether you are talking to the other driver's insurance company or your own. Sorry to say it, but if you can't reason with the insurance company, you will have to get a lawyer to help you. Try getting your state's insurance dept. to help you before you do this. Hope this helps.

It sounds such as you probably did not exchange lanes as you have been proceeding and hit autos forward on your lane as you have been looking over your real shoulder? in actuality, you have 2 thoughts: bypass nevertheless your coverage and that they are going to pay their damages. If it is minor damages under $500, i don't think of it will impact your expenses that lots. dealing with coverage might shelter you if those human beings pick to take great component approximately you via faking injuries or getting costly estimates. for this reason you carry criminal duty coverage, why not use it? and you do not desire a police checklist to record a declare or for the different events to record a declare. in case you record a police checklist, you will probable get a value tag for failure to maintain administration for having the twist of fate. Your 2d determination is to pay those damages out of pocket as long it is genuine looking and confirm you have them sign a touch saying you're achieved and not longer to blame for anymore than what you paid them.

You can file a claim with the person at fault's insurance company, but the thing with that is that person has to report to their company that it was their fault otherwise they may dispute it then your insurance may need to take them to court

Sue the other person for damages. If it's a small amount, it may not be worth it, because you have to put out some money to file claims. But if a lot is still owed to you, then go for it. Just keep receipts from fixing car and any medical treatment you received.

You can file a dispute with the insurance company, and lawyer up. It is unfortunate, but depending on the amount that insurance isn't going to pay, it may not even be worth the hassle...
