NY State sales tax is based on county - not just the state like most other states are.

There is a state tax and a county tax. It also depends on what you are purchasing. For example, in my county (Suffolk County in Long Island NY) clothing has a tax of 4.625% but everything else has a tax on it of 8.625%.

It seems you answered your own question. what is your source and maybe I comment better on it. Usually NY tries to tax everything they possibly can. Designing a site for a client is a personal service your provide so that's not taxable but down-loadable software is a re-sellable good (separate from your service) and therefore can be taxable.

It depends upon what county you live in. Albany is at 8.50% while Essex is 7.75%. Here's a link that breaks-out the tax by county.
