I had a car accident and was in the wrong even though the guy was speeding for failing to Give Way the police were called and I don't have insurance and the guy didn't as well. His car to fix is a cost of a new car and me and my husband can't afford it. Help what do we do?

Not having insurance in Australia is not illegal and I am also a young Mum with 3 kids under 4 so if I did work I still would not have heaps of money I am not an unemployed bum and I am a full time Mum.

find a way to pay for it. It was your fault, should that person lose his car because of you? not to fair I should think.

People that drive without insurance should be jailed in my opinion.

I don't mean to sound rude but -.. Even "Safe Auto" can at least get you legal and it's not incredibly expensive.

I don't understand how people can drive around with NO car insurance - with that "CHANCE" of something going wrong in the back of their mind... and the worry involved in wondering "how would I pay for something like that if I had an accident?!" Flip burgers a couple of nights a week and go get a policy that "at least" keeps you legal.

Then.... you would be on here asking how to make grape jello and NOT... how to get out of buying someone a new car because you didn't have insurance.

I don't live in Austrailia but would assume if the guy was at fault he has some kind of responsibility to you legally! You more than likely need to pursue some kind of court claim to protect your intrest posssibly through an attorney! Without insurance, that's a dead end street!

you have to some how prove that you are not responsible for the accident and have enough proof that he was on wrong way. look for the weak points of the other guy and make a move. if you can let me know exactly what happened i can think of a way. if you are responsible then forget it and pay him or talk to the guy.

Well you could refuse to pay it and see if this other uninsured loser decides to sue you or forget it. Then you'd have your day in court and the liability would be decided there too along with damages. Of course if you lose then you'll have a judgment against you that you'll definitely have to satisfy. Have you learned anything about this?

If you were in the wrong as you said, you have no choice but to pay what you owe.

justdon't pay for his.2 wrongs do not make him right an you not.he was wrong to so pay your own.
