the other driver was very negligent with one hand on the steering wheels.I've already told my insurance company that the other driver was negligentaly driver while on the cellphone.What will happen next.

depends on your insurance you might not have to pay anything they will need the car to evaluate then they decide whether it was or wasn't your fault.

Your insurance company will investigate if they are handling your damages under collision and they will determine if they can get their money back from the other person's insurance. You didn't give any details other than the person talking on the phone with one hand on the wheel, but which car was over too far? The negligence isn't the distracted driver, unless she breached a duty owed to other drivers and caused your damages. Going on the assumption that she did, that's what will happen.

You can also file directly against her carrier. They will also have to investigate. You should cooperate as much as you can if you want your damages paid.

Well, Wait and see. That seems to be the problem , one of our neighbors has just had an accident , and was rear ended by a girl talking on the cell phone. I had the same problem when a young driver smashed into my brand new car, while talking on a cell phone. and did $5000. of damage He did not see the red light nor my car waiting for the light to change. the insurance co paid for the repairs, however,.... who is going to tell these people to pay attention to their driving ? I hope you get better results than we did . It is expensive, and some comes out of our pockets .

Who had the right of way? Driving with a cell phone is not illegal so it goes back to the basic laws of the road.

Depends on the state. most states do not have the laws in place for it to be illegal to drive and talk on the cell phone. so they would just be in trouble for hitting you.
