Also what happens if they put a lein on our home. My wife gets the SSI and I dont receive anything. The home is only in my wife's name and the balance is in my name.

No. SSI cannot be garnished. The Anti-Assignment clause of the Social Security Act, 42 U.S.C. §407(a), states that a person's entitlement to Social Security payments shall not "be subject to execution, levy, garnishment, or other legal process."

If it's been charged off it was most likely sold to a collection agency. The only way they can garnish anything is if: a. it is legal in your state, 2. it is a regular practice of the collection agency, 3. and they have exhausted all other efforts. See if they will take a settlement for less money.

there is no chance they can garnish a ssi check. If taken to court in a suite the judge will dismiss.

but you should be a man and call the credit card company and make some type of payment plan with them.

it isn't their fault that you didn't plan for your future and now all you have is ssi

i dont think that government money can be touched but it may come out of your tax return
