depends on the situation but my brother in law was killed in a car accident which had nothing to do with his driving it was the other persons fault so i think that person should be punished with more than just careless driving

You are open to interpretation when the charge is dangerous driving. But careless driving can mean many different things, crossing on the shoulder, driving left of center, etc. and maybe it was more of an accident. Dangerous driving would most definately be on purpose without regard for human life.

It all depends on the circumstances and the investigation.

However, it does appear that too many motorists who kill - especially whilst driving illegally, get off with lesser penalties - and this is wrong.

But no, careless is not dangerous - dangerous is more deliberate - speeding etc. Whilst careless could be construed as a momentary lack of concentration.

if ur driving was deemed to be correct, right speed/side of the road etc.. and some one hit u or u hit them and either they died or a bystander and let's say u were either distracted or was changing radio station etc.. u would be charged with careless driving (not paying attention) and if u were speeding, overtaking at the wrong time/place or driving erratically u would be charged with dangerous driving.

Jan G is correct, and also consider that "accidental homicide" can, and often does come into play depending on the PA. And to be honest, if the family of the victim has the energy it is highly possible for you to be sued in civil court with a great likelihood of success. I would worry about the greater implications here and get with your attorney to consider pleas. A jury trial, which you are very likely to get, will result in your coming out rather poorly. Plea if you can.

Because you could kill somone without driving dangerously! Just because you kill someone while driving does not automatically make you a dangerous driver.

Accidents happen, people drive fast and don't think about the consequences. They probably didn't mean to kill him, living with the guilt of your friends death is punishment enough for that person.
