Its a bit of a long story, but basically the Tax credits office have been paying me, even though I have informed them that I am now married. I have telephoned them, writen to them and told them I am not entitled to any money. They kept paying money into my account, eventually after two years I have finally got them to stop, but they have now asked for all the money to be paid back within 1 month. They made this error so can I appeal against it???

actually yes you can appeal if you have proof you did phone them try your phone bills with their numbers i have been in this circumstance they still paid you even though you told them but you do need proof or you will have to pay back the inland revenue is a bunch or retards (sorry if you took offence they dont know what is going on in their own office good luck)

Me and my husband are in a very similar position, 3 years ago we started our own business, I informed the tax credit office of this straight away and I was told that they would keep paying it into our bank account until we could give them some figures on what we earn!! Being a new business we wouldnt know this until after the first year of trading.
On two other occasions I phoned them to ask them to stop paying money into our bank account, we were told the same as before. We now have to pay this money back to them £2577.00 (we havn't got it) We appealed TWICE because we have since found out that we were entitled to a small monthly payment of child tax credit but they say that we still have to pay it back (even though we were actually entitled to some of it)because we didnt fill the claim forms in!!
and there it nothing we can do it seems!!

You can appeal, they'll probably still want the money back, but might give you longer to pay it. Hurry up though because even though they can change their minds about payments years after the event, us mere mortals only have 30 days to appeal a decision.

Good luck, the excat same thing has happened to my mum each month for the past 3 years she was ringing them to canceal it s she was no longer entitled. They are demanding the money back and when she said she kept telling them - they don't believe her. They somehow "don't" keep the recordings of the phone calls made.

Yes you can appeal. Take all your paperwork to the citizens advice bureau. This is a very common problem for CAB.

Yes and you should. Contact the Citizens Advice Bureau immediately and take all paperwork with you!
The very least they can do is get you more time to pay it back!

I would definately appeal.I had heard on the news about mistakes like this and the overpayment has been written off.You have a 50 50 chance.I would fight it.They are complete idiots.

no, you knew the money wasnt yours so you shouldnt have spent it! however i think you can ask for time to pay if it will cause you financial hardship

I'm not sure that that would work, if you knew it was not your money you should have sent the money back. this will be their defense. you knew the money wasn't yours but you spent it anyway.
