Theoretically, it's divided into Executive, Legislative, and Judicial Branches. Unfortunately, modern politics have made this system moot. It's pretty much a free-for-all now.

Congress has the power to tax, to pay debts, to borrow money on the credit of the U.S., to regulate commerce, to oversee naturalization, to coin money, to establish post offices and roads, to declare war, and to make all laws as are necessary to oversee its powers. The president is commander-in-chief of the armed forces, he has the power of political appointment to fill vacancies on the Supreme Court, and he has the power of the veto. The judicial has the power to try and interpret law.

It seems it doesn't matter what the constitution says anymore. It all depends on the Judge hearing the case.

the constitution is being interpreted to benefit those in power to the detriment of the people.

The house of representatives and congress are meant to make sure that the president does not abuse his power.

Obviously they're not very good at their jobs.
