Some states allow that wait persons be paid less than minimum wage. You should find out about laws in your state. Usually, if you are working in one of those states, the presumption is that your tips added to your wages equal the state minimum wage. If you are falling short, you should speak to the bookkeeper or your boss, because, in most of those states, they are required to make up the difference so that, one way or the other, you get minimum wage.
Try to find out the law before you approach your boss.

If a server didnt get enough tips to equal minimum wage, the restaurant I used to work at would compensate. If that happened enough though, the server would lose his/her job b/c the company would assume they werent a good server. You've got to bust your butt to make tips, and some people will not tip no matter how good of a job you do. Maybe you should switch comanies. If you dont like your job, it shows in your work.

I used to wait tables. Waiters never make minimum wage. They must depend on tips for their money.
The only way to get a raise is to provide superior service, and get good enough to work in a more expensive restaurant, where expectations are even higher... but so are the tips.

NOPE no law against it... Sorry to tell you this. but due to the fact you are entitled tips you are not entitled to min wage. It is the determination that you CAN make min wage (if you are a good enough wait person) I went through the same thing as a mechanic, ( I was entitled tips) yet I did not make enough off of parts and labor to claim min wage
